Legal Questions

Legal Issues & Q&A
Many public science teachers assume that they cannot present the scientific theory of Creation in their classroom.  This misconception may be due to a number of regional court cases, news stories and other sources that make it seem that teaching Creation is illegal.

In fact the Supreme Court has never outlawed the teaching of Creation.  It has outlawed the mandating of Creation instruction by state and national school boards.  Some regional cases (Dover) were decided by District courts and ruled against regional school boards.  In these same cases the Supreme Court (and other courts) have affirmed the right of the individual science teacher to teach science in the way he/she feels will best serve the needs of his/her students.

Supreme Court Decision Supreme Court Decision: Edwards vs. Aguillard (1987): “… teaching a variety of scientific theories about the origins of humankind to school children might be validly done with the clear secular intent of enhancing the effectiveness of science instruction.”

This series was created with legal rulings in mind to create a valid tool for “enhancing the effectiveness of science instruction.”
